Idaho Student Killings: Kohberger’s attorney requests evidence

MOSCOW, Idaho (Court TV) – Defense attorneys representing Bryan Kohberger, the man accused of murdering four college students in their off-campus home, have filed new motions in court requesting evidence from the prosecution.

Kohberger, a former criminology student at Washington State University, is charged with the murders of Ethan Chapin, Xana Kernodle, Madison Mogen and Kaylee Goncalves on November 13, 2022. The victims were in their rented home near the University of Idaho campus when police said Kohberger broke into the home and stabbed them to death.

In a filing on May 4, Kohberger’s attorneys filed a motion to compel discovery for evidence previously requested on February 3 and March 24, 2023.

Kohberger’s attorneys have specifically requested “all body cam and dash cam footage from officers involved in the search and arrest of Bryan Kohberger in Pennsylvania,” lab reports detailing the forensic evidence collected from his vehicle and his parents’ home, where he was arrested, police reports related to his arrest and incarceration in Pennsylvania and all notes and recordings from officers in the Moscow Police Department who were investigating the murders.

The motion to compel is also asking for the training records of specific officers to be released to the defense. The motion does not name the specific officers or specify the department from which the defense is requesting the records.

Despite previous requests for the evidence, Kohberger’s attorneys said in the motion that as of May 4 the materials had not been turned over to them.

The judge overseeing Kohberger’s case has issued a gag order in his case, preventing any participants in the case from talking to the media. Much of the documents and evidence related to the case remains under seal, pending Kohberger’s trial.

The family of Kaylee Goncalves has filed a motion asking to be released from the gag order, citing their first amendment rights. Kohberger’s attorneys have argued the gag order is critical to ensure their client receives a fair trial.

A hearing on the Goncalves family‘s motion is scheduled for May 22. Kohberger is scheduled to appear in court for his preliminary hearing on June 26.
